My years in the Automotive business taught me you can't please all the people all the time. So, after the excellant service I got at Midas Muffler Shop & Complete Auto Service at 680 West 7th Ave in Eugene, Oregon, I decided to write a review after reading a few of the dissatisfied reviews on Yelp that rated the shop at a 3 1/2 Star Rating. When an industry has a less than stellar reputation, expectations from many customers color their perceptions and are many times never pleased because of those reasons and nit pic and complain about trivial things that are bound to happen in a busy shop. When I see a busy shop I see that as a plus, not the whiners and petty folks that never give good reviews. The first bad review on Yelp I saw the reviewer showed his ignorance right away complaing that he was miffed that he was charged an hour rate for a job he felt took a half an hour. Auto shops charge according to the "Chilton Manual" If the shop has a pro that can do the job in less time, is a good thing because there will always be a tech person that takes longer than Book Time. This reviewer bragged he knew alot about car repair but oviously was blowing smoke to justify his ignorance. It's hard for any business to get 5 stars across the board no matter if they deserve it. In the food service industry a good chef will hav e a bad day for example and get the one star review that brings the average down putting out a dish that is sub-par to the restuarants normally high standards. The owner of the Midas, Steve, went above and beyond great customer service and gave me a ride home because Eugene had a snow storm and the cab company I had a booking set to pick me up at the time I dropped my truck off after my usual auto shop recommended I take my truck t9 Steve, Unfortunatley, for my old shop, Steve won my business now as he gave me a ride home in the snow storm that hit so hard my cab company could not honor my pick up reservation as they only had five cabs working. So, hopefully my five star rating will catch his shop up to the four stars that is about as good as it gets for Aiuto Repair shops anywhere. He did it out of a good heart and his shop rates are lower than most.

Masone further reported that “The Vets should be told of all offers as I am sure more reputable programs who have not failed these Vets, have offered also.” Just today Feb 6th, Masone discovered the Eugene address for a Reveille FoundationPO Box had been vacant for two years. ‘Reveille Foundation lied about having an office and mailbox here and I can't believe the VA or other media did not investigate Reveille Foundation " Reveille Foundation's Arizona adresses are being inestigated also"...said Steven Masone. After being in the Hospitality business for 30 years, I have found that first impressions set the customer's expectations and has the greatest effect on their decisions to be a repeat customer. "You have only have one chance to make a first impression!"
My first impression was when I called to confirm my reservation. No AI or third party live or software annoucements etc... that are cold and impersonal messages...but a personal greeting by General Manager Eric Peluschenko. I was impressed.
When I arrived, Athena at the front Desk was sincerely friendly and even helped me personally with my baggage to my very nice 2nd floor King room. Checking out, on front desk was Barbara, who was as sincerely helpful and competent as Athena.

I. Motion
Plaintiff Disability Rights Oregon (DRO) hereby moves this Court pursuant to its
inherent authority to enforce its own orders, to impose civil contempt sanctions, and to issue
writs to require compliance with its own injunctions or judgements. See Stone v. City & Cnty. of
San Francisco, 968 F.2d 850, 856 (9th Cir. 1992), as amended on denial of reh’g (Aug. 25,
1992) (federal courts have “wide latitude” and “inherent power” to enforce their “lawful orders
through contempt). The federal rules confer on federal courts the authority to issue injunctions.
Fed. R. Civ. Pro. 65. The rules specify who is bound by those orders, including the “parties” to a
case. Fed. R. Civ. Pro. 65(d)(2).
The All Writs Act also provides federal courts with the ability to safeguard the integrity
of their proceedings and judgments. 28 U.S.C § 1651(a)(“The Supreme Court and all courts
established by Act of Congress may issue all writs necessary or appropriate in aid of their
respective jurisdictions and agreeable to the usages and principles of law.”); see also Doe #1 v.
Trump, 458 F.Supp.3d 1220, 1223 (“There must be some connection between the underlying
claims and the newly-challenged conduct for that conduct sufficiently to interfere with the
Court’s jurisdiction to support an extraordinary writ under the All Writs Act”). Plaintiff DRO
respectfully asks this Court to use its “inherent power to enforce compliance” with its own
permanent injunction and to issue appropriate remedial orders including but not limited to
levying civil contempt. Shillitani v. United States, 384 U.S. 364, 370 (1966).
II. Brief Memorandum
In 2002, after a bench trial, this Court issued a permanent injunction requiring
Defendants to “ensure that persons who are declared unable to proceed to trial” be committed “as
soon as practicable” to the state psychiatric hospital or other suitable treatment facility “in a

reasonably timely manner, and completed not later than seven days after the issuance” of an
appropriate order finding the individual unfit to proceed to trial. ECF 51. For years, Defendants
maintained compliance with the permanent injunction. However, starting in the Fall of 2018,
Defendants have been largely out of compliance with only brief periods of compliance. At the
last hearing in this matter, Defendants stated that they had no projection of when they would
come back into compliance with the permanent injunction. Cooper Decl. Ex. A at 27.
During the last few years of noncompliance, at least two jail detainees found unable to
aid and assist have died while waiting for a hospital bed, as a result of complications of their
mental illnesses and the related inability to eat or drink. Cooper Decl. at ¶3-5. Hundreds of other
detainees have spent weeks or months languishing in jail, often in isolation and without
treatment, while their conditions worsened. The human costs of Defendants’ noncompliance
have been enormous. Plaintiff DRO seeks relief from this Court due to Defendants lack of an
immediate plan to comply with the permanent injunction.
III. Procedural History
Plaintiffs filed a complaint in this matter on March 19, 2002, alleging tha
