Motion Plaintiff Disability Rights Oregon (DRO) hereby moves this Court pursuant to its inherent authority to enforce its own orders, to impose civil contempt sanctions, and to issue writs to require compliance with its own injunctions or judgements. See Stone v. City & Cnty. of San Francisco, 968 F.2d 850, 856 (9th Cir. 1992), as amended on denial of reh’g (Aug. 25, 1992) (federal courts have “wide latitude” and “inherent power” to enforce their “lawful orders through contempt). The federal rules confer on federal courts the authority to issue injunctions. Fed. R. Civ. Pro. 65. The rules specify who is bound by those orders, including the “parties” to a case. Fed. R. Civ. Pro. 65(d)(2). The All Writs Act also provides federal courts with the ability to safeguard the integrity of their proceedings and judgments. 28 U.S.C § 1651(a)(“The Supreme Court and all courts established by Act of Congress may issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law.”); see also Doe #1 v. Trump, 458 F.Supp.3d 1220, 1223 (“There must be some connection between the underlying claims and the newly-challenged conduct for that conduct sufficiently to interfere with the Court’s jurisdiction to support an extraordinary writ under the All Writs Act”). Plaintiff DRO respectfully asks this Court to use its “inherent power to enforce compliance” with its own permanent injunction and to issue appropriate remedial orders including but not limited to levying civil contempt. Shillitani v. United States, 384 U.S. 364, 370 (1966). II. ECF 51. For years, Defendants maintained compliance with the permanent injunction. However, starting in the Fall of 2018, Defendants have been largely out of compliance with only brief periods of compliance. At the last hearing in this matter, Defendants stated that they had no projection of when they would come back into compliance with the permanent injunction. Cooper Decl. Ex. A at 27. During the last few years of noncompliance, at least two jail detainees found unable to aid and assist have died while waiting for a hospital bed, as a result of complications of their mental illnesses and the related inability to eat or drink. Cooper Decl. at ¶3-5. Hundreds of other detainees have spent weeks or months languishing in jail, often in isolation and without treatment, while their conditions worsened. The human costs of Defendants’ noncompliance have been enormous. Plaintiff DRO seeks relief from this Court due to Defendants lack of an immediate plan to comply with the permanent injunction. III. Oregon Citizens Commission on Human Rights (CCHR) Calls for deeper dive into Oregon State Hospital's Involvement in death of Skye Baskin. Oregon’s mental health system may be responsible for a 27-year-old man’s death last month.

Skye Edward Baskin, a Black man who was, according to family members, likely homeless, had been arrested in Roseburg in March for wandering in and out of traffic on the freeway.The Executive Director of the Group, Steven Masone said, "It's like 'One Flew Over The Cukoos Nest' all over again." Masone referred to the Jack Nicholson Movie that was based on a true story at the old State Hospital, now a Museum. Steven Masone was intrumental in the California Bill AB 1032 in 1976 that outlawed forced ECT when he was previously with CCHR and saw recent cases of patients not being fully informed of their rights and voluntarily agreed to the barbaric procedure. Thus he applied for the open Executive Director position for CCHR Oregon to get action taken involving many Civil Rights complaints atthe Salem  Hospital. Masone is also a member of the RFK Jr team and said " The Secretary of HHS, RFK Jr,  has the authority to shut down any Hospital in the nation." Masone also wants the Autopsy report on Skye Baskin"released ASAP!"

               

West Eugene Planet Fitness discriminaing Against Disabled Boycott!

 

Planet Fitness on West 11th in Eugene Disciminated Against Disabled Veteran who became hombound, and due to his asking them by phone to cancel his membership as he became immobile due to several conditions and has been having to pay because their franchise rule demands he had to come in person to cancel. Because the veteran cannot drive due to serious eye conitions as well as mobility issues. They denied his accomadation request violating the Americans With Disabilities Act. The American Disabilities Act (ADA) requires all facilities, including gyms and workout centers, to be safe, adequately equipped, and maintained to optimize their accessibility to non-disabled and disabled patrons. This requirement includes people with disabilities or physical challenges. He had just moved back from PDX area where he was a member of a Cororate Planet Fitness Gym that had no such rule. He did not yet have anyone to support him and take him down there as his chronic pain still was a barrier to have to leave his home even if he could find transportation. He planns on filing a lawsuit with the Civil Rights Division as law requires he do that before filing a lawsuit. Unfotunately for Planet Fitness, he knows the ropes and has won several suits as he belongs to an ADA  Advocay Organizatim.Basicaly The DOJ Attorneys become his lawers.         Snake venom-related enzyme underlies COVID-19 mortality

 Published in The Journal of Clinical Investigation, has identified a snake venom-related enzyme that may be the key cause of COVID-19 related mortality. Their findings have revealed a brand-new target for potential therapeutic treatments.
• The role of lipid metabolism in COVID-19
• Up to 80% of individuals infected with SARS-CoV-2 are asymptomatic or develop mild to moderate symptoms. However, COVID-19 can be life-altering and ultimately fatal for the remaining 20%, with multiple organ failure often leading to mortality. Consequently, there is an urgent need to identify the cellular and molecular mechanisms responsible for severe COVID-19.
• Recent studies have suggested that lipid metabolism plays a key role in determining an individual’s response to COVID-19 infection. There is evidence that SARS-CoV-2 modifies the levels of various lipids in host cells. This indicates that severe COVID-19 may be accompanied by phospholipases that cleave intact phospholipids from cellular membranes.
• The team behind this study investigated this theory by using lipidomic methods to analyse blood samples. Samples were taken from individuals with no disease, mild COVID-19 and severe COVID-19 as well as deceased COVID-19 patients.
• Identification of key enzyme
• The analyses showed that deceased COVID-19 patients had the most significant changes to their lipid profile. In total, 181 unique molecules were identified in these patients, many of which were associated with phospholipid metabolism.
• Further targeted lipidomics revealed that in comparison to survivors, deceased patients had elevated levels of a circulating, catalytically active enzyme called secreted phospholipase A₂ Group IIA (sPLA2-IIA). Their sPLA2-IIA levels were 9.6-fold higher than in mild patients and 5-fold higher than in severe patients. In addition, high sPLA2-IIA levels were significantly associated with multiple organ dysfunction. This implies that sPLA2-IIA may drive the organ failure seen in fatal COVID-19 cases.
• The study further demonstrated the importance of sPLA2-IIA through the use of a machine learning method. Out of 80 clinical indices, the algorithm identified sPLA2-IIA level as the key feature that differentiated survivors from non-survivors. This highlights a potential method for identifying COVID-19 patients at high risk of mortality.

PPA Performing Arts and School of Blues Debuts in Oregon City, Oregon & Anderson Island, WA

 

  

 

• Americans have a love affair with music & entertainment. From Broadway musicals to the latest craze of talent shows that make stars and celebrities for new talent instantaneously. Oregonians & Washingtonians have always had a love affair with it's performing arts probably more so than any other market it's size in the country. The recession in 2008, and now the pandemic has hindered a lot of the arts groups including our school's music and drama programs which serve as the gene pool that supplies our community with all the great talent for community theatre, ballet, symphony, music venues, etc... 

•  Entertainment night life however has seen better days, and may not recover for another year or so. Outside of the younger generation's club venues that cater to their likes and “Club music..., showroom and dinner shows along with Broadway musical productions on the regional playhouse level for the 35+ market is still a viable market. Due to higher costs in overhead and talent, royalties, advertising,  producing quality productions are becoming cost-prohibitive. The National Endowment for The Arts, (NEA) has  released the latest exhaustive survey that shows musicals are attended almost twice as much as non-musicals nationally. Oregonians love their performing arts and rally to help maintain them when a call goes out for support. Musical Theatre has weathered some major storms with help from fans and Grant support.       

     

Pro-AmSchool of Blues project is a Non Profit Organization where professional artists and business people teach young people, both academically stable, and those at risk... to learn all phases of a Dinner Theatre and a collaborative Performing Arts Program. There will be a professional food and beverage component and culinary school training program, and a Hospitality Industry component that will prepare students to not only become skilled in all phases as workers, but also provide entrepreneurial training and hands-on management opportunities. Then if desired, cross trained in Theatre Arts. And vice-versa. As an after school and summer program, PPA will utilize family, community and school personnel to be involved with students' internship and participation in PPA. PPA will coordinate and liaise with family, educators, and any other relevant person or agency involved in student's counselling and guidance for future school and or job placement opportunities.

PPA & School of Blues is a project conceived by Producer Steven Masone. Masone produced Sacramento's first Musical Dinner Theatre in 1976. He then went on and Produced another Dinner Theatre in the Historic Old Sacramento District with The Bacchus Theatre Troupe. From Musicals to Melodrama, Improvisational Comedy Troupes and Musical festivals, Steven Masone brings his many years of experience to Oregon, where he decided to go back to college to finish his education that was put on hold as he was so busy with many different projects over the years. He is an actor, musician, dancer, choreographer, director, writer, media publisher, and Parent, raising his 14 year old Grandson. Masone also owns "Masone & Associates" Artist Management Company he is currently resurrecting that business from inactivity. Graduating from Lane Community College, Masone now is in his last year at Oregon State University. Steven Masone is also very active in Veterans issues, and with Eugene’s Hope Center Director; James Rabe, working with the VA Hud/Vash teams, helped start and was Pgm director for the Veteran's emergency homeless shelter at The Hope Center @ 1161 Grant Street, Eugene, Or, where they also feed all the homeless hot meals every Friday opening at 10 am. Hundreds of veterans have been helped into permanent housing in the 5 years history of The Hope Center. He is currently the Chapter Coordinator for Guitars4Vets.

 G4vets teaches guitar lessons for our returning veterans as a music therapy vehicle to provide music and support for PTSD issues and awards brand new guitars after the 10 lesson series taught by volunteer instructors. There are 82 chapters in the U.S. and growing. Over 13,000 have graduated from pgm. After support is continued with official VA support services. He is a member of American Legion Post # 3, and has partnered with The Kim Sticka PTSD and Performing Arts Foundation. Executive Director; Ron Sticka has invited Masone to serve on The PTSD Task Force being organized by that organization.

     PPA will initially outsource much of the classroom curriculum with established culinary business, and  performing arts programs in local high schools and college/technical schools where resources are available.The Theatre Arts program will be a first phase, where students will be involved with production of a musical chosen where the professional theatre company will have trained and rehearsed all students involved as cast members, and all other aspects of show. However, the professionals will appear and perform in the shows that will be competitively priced and staged like any regional level Dinner Theatre Operation. After School of Blues is on it's feet, Masone plans on producing an original Musical about the roots & evolution of American Music through The Blues in his Pro-Am concept Dinner Theatre. Friday Night Blues Jam @ New Jalisco Family Mexican Restaurant, 941 Pearl st. starting Nov 2 at & pm. Youth allowed to participate till 10:00 pm. Every Friday thereafter! Sundays are planned for afternoon sessions soon.

Oregon schools in the majority of rural districts, have been without music and drama-theatre programs for years, causing a dearth of thespians and music majors to keep building their-talent pool with. This will happen wherever the arts are forsaken and sooner or later, the Community Theatre, Ballet, Symphony's talent pool as well as all of the local entertainment industry will dry up.
